Here is what I think about President Bush's nomination to fill Sandra Day O'Conner's vacancy on the Supreme Court:
I am a liberal. If I were a member of the Supreme Court, I would rule against ANY limitation on a woman's right to choose, I would allow affirmative action in college admissions, I would allow respect the wisdom of providing a separation between church and state always. I would rule any state constitutional amendment banning gay marriage as being unconstitutional.
I do understand though, that I may not be in the majority view on every decision I would make. I believe adamantly that President Bush could have salvaged his legacy if he had nominated a moderate to the Supreme Court. Instead of FINALLY showing his detractors that he is a reasonable man, that he respected the role that Sandra Day O'Conner has played on the Court, he chose a rock-solid conservative who will undoubtedly vote to overturn Roe v. Wade, limit the powers of the federal government in exercising the Commerce Clause, allow the execution of the mentally retarded as well as juveniles, and much much more.
Because I realize that I am not in the majority view on every issue, I believe fervently as a liberal that having a Supreme Court beholden to either the conservative or liberal ideologies of America is most unwise. How can most of the country have faith in a Court so beholden to an extremist agenda... on either side??? Clearly, the Supreme Court of the United States needs to maintain the role it has played for quite some time. It really shouldn't make decisions as I would make, were I given ultimate discretion, because huge sea changes in American life and jurisprudence should not be dictated by a body not elected by the people. Can you imagine the United States is Roe were overturned? The OVERWHELMING MAJORITY (at least 65% of the American people) do not support overturning this established legal precedent. But, we stand ready to do just that with the nomination of John Roberts.
If the American people overwhelmingly change their view of a legal precedent, the Supreme Court, decades after a decision, should feel safe in overturning a decision with the American people behind the. But again, I feel that we have come to the point where President Bush has nominated a man to the Supreme Court who will be an activist judge, and will undue so much important progress made by his predecessors.
Let's see how much faith the American people have in our courts after John Roberts and Rehnquist and Scalia and Thomas and Kennedy, by fiat, destroy the right to privacy... overturn Roe v. Wade, allow the execution of juveniles and the mentally retarded, ban civil unions, begin to ignore Miranda rights, outlaw affirmative action, and allow the 10 commandments to be displayed on every inch of wallspace in every public building in the country.
American Theocracy could be exciting. If you think so, urge your senators to vote for John Roberts.
